TERMS AND CONDITIONS

INTRODUCTION

These Terms and Conditions ("Terms") govern the 60-Day Ranking Improvement Guarantee ("Guarantee") offered by Ezzey Marketing ("Company") for the Ezzey Boost program ("Program"). By enrolling in the Program, you ("Client") agree to be bound by these Terms.

ELIGIBILITY REQUIREMENTS FOR GUARANTEE

To qualify for the 60-Day Ranking Improvement Guarantee, Client must meet ALL of the following requirements:

• Google Business Profile Access: Client must provide full access to their Google Business Profile (GBP) to the Company.
• Google Verification: Client's Google Business Profile must be fully verified with Google.
• Minimum Reviews: Client's Google Business Profile must have a minimum of three (3) reviews at the time of Program enrollment.
• Established Profile: Client's Google Business Profile must have been established for a minimum of six (6) months prior to Program enrollment.
• Existing Rankings: Client must have some existing rankings in Google search results, even if not appearing on page 1, that can be improved through the Program.
• Physical Location and Phone Verification: Client's Google Business Profile must have a verified physical location and phone number correctly listed. Business must be done out of this location. E-Commerce does not apply.

GUARANTEE TERMS

• Guarantee Period: The Guarantee applies for a period of sixty (60) calendar days from the date of Program implementation.
• Definition of Improvement: For purposes of this Guarantee, "ranking improvement" is defined as any of the following:
  • Increase in position on Google search results based on Client's location
  • Improved visibility of existing ranked keywords
  • New keyword rankings attributable to the Program's boosting activities
• Measurement: Ranking improvements will be measured using industry-standard SEO tracking tools selected by the Company. Baseline measurements will be taken at Program implementation and compared with measurements at the end of the 60-day period.
• Guarantee Fulfillment: If no positive ranking improvement (as defined above) is achieved during the 60-day period, the Company will continue to provide the Program services for an additional sixty (60) days at no additional cost to the Client.

LIMITATIONS AND EXCLUSIONS

The Guarantee does not cover ranking decreases due to Google algorithm updates or changes to Google's policies that occur during the Guarantee period.

Any actions taken by the Client that negatively impact their Google Business Profile or website SEO during the Guarantee period may void the Guarantee, including but not limited to:

• Changing business name, address, or phone number
• Removing or significantly altering website content
• Receiving negative reviews that lower overall rating
• Violating Google's terms of service

The Guarantee does not cover ranking decreases due to actions taken by competitors or third parties.

The Guarantee does not apply in circumstances beyond the Company's reasonable control, including but not limited to natural disasters, acts of government, or widespread internet/service outages.

Client must comply with all of the Company's reasonable requests and recommendations related to the Program for the Guarantee to remain valid.

CLAIM PROCESS

• If the Client believes they qualify for the additional 60 days of service under the Guarantee, Client must submit a written claim to the Company within seven (7) days after the end of the initial 60-day period.
• The claim must include specific details regarding the lack of ranking improvement.
• The Company will review the claim and respond within ten (10) business days.
• If the claim is approved, the additional 60 days of service will begin within five (5) business days of approval.

GENERAL TERMS

• No Refunds: This Guarantee provides for additional service time only and does not entitle Client to any monetary refunds or compensation.
• Non-Transferable: The Guarantee is specific to the Client and cannot be transferred to another business or entity.
• Modification: The Company reserves the right to modify these Terms at any time, with modifications taking effect upon notification to Client.
• Entire Agreement: These Terms constitute the entire agreement between the Company and Client regarding the Guarantee and supersede all prior communications regarding the same.
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
• Jurisdiction: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Scottsdale, Arizona.
